From the perspective of New York State's Human Rights Law, the dissolution of the National Diversity Council (NDC), a nonprofit, following allegations that its founder, Dennis Kennedy, a Black man, along with other top employees, misappropriated millions of dollars, raises concerns about the potential for abuse and mismanagement within organizations promoting Diversity, Equity, Inclusion, and Belonging (DEIB) initiatives, which could indirectly lead to discriminatory practices. The legal suit alleged that Kennedy received an "excessively high salary" and operated the non-profit as a façade to benefit his for-profit diversity consulting firm, Diversity & Leadership Inc (D&L). The group’s 2020 IRS disclosure said Kennedy was paid $450,000 for 10 hours of work per week. In 2022, at the height of corporations’ DEI hype, Kennedy, chief executive officer Ángeles Valenciano, and chief financial officer Jason deGroot also “unilaterally decided that they were owed almost $3 million in ‘back pay,’ and then paid themselves more than $1 million of donor funds,” the lawsuit said. Beyond his for-profit venture, D&L Inc., Kennedy also oversaw two Texas-based non-profits, the Texas Diversity Council and the California Diversity Council. The lawsuit alleged that these entities were used to facilitate double payments of salaries. Its “Emerging Leaders Internship Program” explicitly aimed to create pathways for “underrepresented” college students to connect with employers actively seeking “diverse” talent. NDC’s practice of segregating people into two adversarial racial categories, BIPOC vs White, can be seen as problematic under the NYSHRL and may raise concerns under federal law and with the EEOC, as it creates distinctions based on race that could foster division, disparate treatment, and a hostile work environment, potentially violating prohibitions against discriminatory employment practices. In 2024, in what was advertised as the conference’s 21st year, Hillary Clinton, Magic Johnson, Castro, and Eric Holder spoke. For $8,900, participants could “take photos with each keynote speaker listed on the Speakers page except for Hillary Clinton.” The collapse underscores the critical need for robust oversight and ethical conduct in any organization, particularly those operating in sensitive areas like diversity and inclusion, to ensure that their initiatives are implemented fairly and without causing unlawful discrimination or harassment against any protected group. The NCD engaged in a variety of activities, including offering professional certifications like the National Diversity Council Certified Diversity Professional (CDP), specialized training programs such as the DEI Bootcamp, and dedicated resource centers like the Inclusion Lab, National Belonging Institute, Center for Cultural Competency, and Center for Allyship. It organized and hosted numerous events, such as the large-scale annual National Diversity & Leadership Conference, Women in Leadership Symposiums, the National Latino Leadership Conference, and the National Black Men in Leadership Summit. It also published materials and partnered with media outlets like Forbes Magazine to disseminate DEIB best practices. Links to board member lists on the NDC website were inaccessible, but affiliate sites mention Olakunle Arowolo (a Black man), Nathaniel Bennett III (a Black man), Katrina Glenn (a Black woman), Celeste Warren (a Black woman), Robin Geiger (a Black woman), Kim Barker (a Black woman), and Elizabeth Campbell (a Black woman), as board members, advisors, and support. Having a majority Black board of diversity champions could be seen as ironic.
